Implied Consent Should Include Informed Consent

There are many issues related to breath alcohol testing that disqualify a person from getting a fair breath alcohol test. Here are a few of them.

The implied consent doctrine says that by driving on the roads, you implicitly agree to take a chemical test if requested by an officer.

But what about informed consent? Drivers need to be informed about the various situations in which they may not receive a fair breath alcohol test.
